Unlike child support, there is no specific formula for determining alimony (also known as spousal support or spousal maintenance), nor is it guaranteed in every case. Rather, alimony is determined on a case-by-case basis.

Generally speaking, the longer the marriage has lasted, the greater the chance that alimony will be awarded. To qualify for spousal support in Arizona, a spouse must meet at least one of the criteria outlined in Arizona Revised Statutes 25-319 (A), such as:

  • A spouse has insufficient property to reasonably support him or herself
  • A spouse is unable to be self-supporting through employment
  • A spouse contributed to the educational opportunities of the other spouse
  • After a long-duration marriage, a spouse is of the age that obtaining self-supporting employment is unreasonable

If one of these criteria is met, the court will consider an additional number of factors to determine the amount and duration of the spousal maintenance award. Accurate documentation of financial information and the marital lifestyle is essential to a fair result.
